How you title your real estate matters A LOT for your estate plan. For example, if owners hold title as “tenants in common” that means each person can transfer their share as they wish during their lifetimes, and at death, their share will go to whoever is named in their estate plan. This is very different than if owners hold title as “joint tenants,” which means that if one of the owners dies, their share passes to the surviving joint owners, and so on. In other words, the last owner living “wins” the property!
